Welcome to Modulynk (“we”, “our”, or “us”). By accessing, browsing, registering for an account, booking an appointment, or using our websites, iOS application, mobile dashboards, or APIs (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”).

Summary for Australian Users: Modulynk operates in compliance with Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in these Terms excludes, restricts, or modifies any statutory consumer guarantees that cannot be excluded by law.

1. Platform Scope & Parties

Modulynk provides an intelligent salon, detailing, and appointment management software suite comprising scheduling calendars, client CRM, automated SMS notifications, waiting room displays, in-person Point of Sale (POS) checkout, and online booking portals.

2. Account Registration & Security

To access merchant features, you must register an account with accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

3. Payment Processing & Fees

Payment processing services on Modulynk are provided through Stripe Connect (and Stripe Terminal for in-person card and Tap to Pay transactions). By using payment processing on Modulynk, you agree to Stripe’s Connected Account Agreement and Services Terms.

4. SMS Messaging & ACMA Spam Act Compliance

Modulynk facilitates automated appointment confirmations, reminders, invoice links, and review requests via Twilio telecommunications infrastructure.

5. Service Availability & Intellectual Property

We strive to provide 99.9% platform availability. All code, design aesthetics, proprietary algorithms, visual themes, logos, and software components of Modulynk remain the exclusive intellectual property of Modulynk. You are granted a non-exclusive, non-transferable revocable license to utilize the platform.

6. Limitation of Liability

To the maximum extent permitted by Australian law, Modulynk and its operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from loss of profits, booking downtime, or payment gateway interruptions.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria and the Commonwealth of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
